Terms and Conditions

1. Scope of Application

These General Terms and Conditions (GTC) apply to all contracts for the rental and use of the Privatesuites of Hallstatt Hideaway, Inh. Vivien Schober, Dr. Mortonweg 24, A-4830 Hallstatt, as well as all further services and deliveries provided to the guest. The sub-letting or re-letting of the accommodation as well as its use for purposes other than accommodation requires the prior written consent of Hallstatt Hideaway.

2. Conclusion of Contract

The contract is concluded upon acceptance of the guest's booking request by Hallstatt Hideaway. The booking confirmation is sent by email. The contract partners are Hallstatt Hideaway and the guest. If a third party has booked on behalf of the guest, they are jointly and severally liable with the guest for all obligations arising from the contract.

3. Services, Prices, Payment

Hallstatt Hideaway is obligated to provide the services booked by the guest and confirmed by Hallstatt Hideaway. The prices stated are total prices in Euro including all taxes. Payment is due upon arrival unless otherwise agreed. Hallstatt Hideaway accepts payment by bank transfer, credit card, and cash.

4. Cancellation

The guest may cancel the booking in writing. The following cancellation fees apply based on the cancellation date relative to the arrival date:

The date of receipt of the written cancellation is decisive. We recommend travel cancellation insurance.

5. Withdrawal by the Landlord

Hallstatt Hideaway is entitled to withdraw from the contract for objectively justified reasons, for example if force majeure or other circumstances beyond the control of Hallstatt Hideaway make fulfillment of the contract impossible, if the booking was made with misleading or false information regarding essential facts (e.g., the identity of the guest or the purpose), or if Hallstatt Hideaway has reasonable cause to believe that the use of the accommodation may jeopardize the smooth business operation, safety, or public reputation of Hallstatt Hideaway.

6. Arrival and Departure

Check-in: from 3:00 PM
Check-out: by 10:00 AM

If the guest arrives later than the agreed check-in date without prior arrangement, Hallstatt Hideaway is entitled to rent the accommodation to other guests after 6:00 PM on the arrival day. Early check-in or late check-out is subject to availability and may incur additional charges.

7. Liability of the Guest

The guest is liable for all damages to the building, furnishings, equipment, or other objects caused by the guest, their companions, or visitors. The guest is obligated to report any damages immediately. Hallstatt Hideaway reserves the right to charge the guest for any damages at replacement cost. Smoking is strictly prohibited in all Privatesuites. In case of violation, a cleaning fee of at least EUR 500 will be charged.

8. Pets

Pets are only allowed in the Privatesuite SEE and Privatesuite HOLZ, subject to prior arrangement and an additional cleaning fee. Pets must be kept under supervision at all times. The guest is liable for any damages caused by pets.

9. Liability of the Landlord

Hallstatt Hideaway is liable for damages resulting from injury to life, body, or health for which Hallstatt Hideaway is responsible. Furthermore, Hallstatt Hideaway is liable for other damages based on intentional or grossly negligent breach of duty by Hallstatt Hideaway. Hallstatt Hideaway is not liable for slight negligence unless essential contractual obligations are affected. Liability for indirect damages, consequential damages, and lost profits is excluded to the extent permitted by law.

11. Final Provisions

Austrian law applies. The place of jurisdiction is the competent court in Gmunden. Should individual provisions of these GTC be or become invalid, this shall not affect the validity of the remaining provisions. The invalid provision shall be replaced by a valid provision that comes closest to the economic purpose of the invalid provision.
